Responsive Tester Terms of Service

These Terms of Service ("Terms") govern your use of Responsive Tester ("the Extension"). By purchasing or using Responsive Tester, you agree to be bound by these Terms. If you do not agree, do not use the Extension.

1. License & Usage

1.1 License Grant

Responsive Tester is licensed, not sold. Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable license to use the Extension subject to these Terms. You do not acquire any ownership rights to the Extension or its underlying code.

1.2 Free Features & Trial

The core preview features are free to use. Pro features (interaction sync and live CSS editing) require a license or an active free trial. The free trial starts automatically on installation and runs for 7 days; when it ends, Pro features lock until a license is activated. The trial requires no payment details.

1.3 Activation Limits

A license permits up to 3 activations. An "activation" refers to installing and activating the Extension on a single browser profile.

1.4 Personal & Commercial Use

The license permits both personal and commercial use. You may use Responsive Tester for client work, professional projects, and business purposes.

1.5 Restrictions

You agree not to:

• Resell or Redistribute: Sell, sublicense, lease, or distribute your license key or the Extension to any third party.
• Share Licenses: Share your license key beyond your permitted activation count.
• Reverse Engineer: Decompile, disassemble, modify, or create derivative works based on the Extension.
• Circumvent Protections: Bypass, disable, or interfere with any license validation, security measures, or usage restrictions.
• Misrepresent Ownership: Claim ownership of or authorship over the Extension or any part thereof.

2. Payment & Refunds

2.1 Pricing

The price is listed at the point of sale and is subject to change at any time without prior notice. Price changes do not affect existing licenses, only future purchases.

2.2 Payment Processing

All payments are processed securely by Gumroad, a third-party payment provider. Your payment information is never seen or stored by the Extension or its developer. Your purchase is subject to Gumroad's terms of service and privacy policy.

2.3 Refund Policy

Every purchase comes with a 30-day money-back guarantee:

• Eligibility: You may request a full refund within 30 days of your original purchase date, no questions asked.
• How to Request: Email violetsmyster@gmail.com with your order details.
• After Refund: Upon refund, your license is revoked and you must immediately cease using Pro features.

Refund requests made after the 30-day period may be considered on a case-by-case basis but are not guaranteed.

2.4 Chargebacks

If you initiate a chargeback or payment dispute with your bank or payment provider instead of requesting a refund:

• Your license will be immediately and permanently revoked.
• Recovery of any costs incurred, including chargeback fees, may be pursued.

If you have an issue with your purchase, get in touch first. Most problems are quick to resolve.

3. Disclaimer of Warranties

3.1 "As Is" Provision

Responsive Tester is provided "as is" and "as available" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

3.2 No Guarantee of Compatibility

There is no warranty that:

• The Extension will function on every website, browser, or system configuration.
• The Extension will be uninterrupted, error-free, or free of bugs.
• The Extension will meet your specific requirements or expectations.
• Any errors or defects will be corrected.

Some websites use technologies or security measures that prevent them from being previewed in frames, or that interfere with interaction sync and live editing. Such incompatibilities are outside the Extension's control.

3.3 Use at Your Own Risk

You acknowledge that use of the Extension is at your own risk. No responsibility is accepted for damages, data loss, system issues, or other harm that may result from using the Extension, including but not limited to:

• Conflicts with other browser extensions or software.
• Browser performance issues.
• Any impact on websites you visit or edit while using the Extension.

4. Limitation of Liability

To the maximum extent permitted by applicable law:

• There shall be no liability for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Responsive Tester.
• There shall be no liability for any loss of profits, data, goodwill, or other intangible losses.
• Total cumulative liability for any and all claims arising from or related to these Terms or the Extension shall not exceed the amount you paid for your license.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

5. Termination

5.1 Termination by You

You may stop using Responsive Tester at any time. Uninstalling the Extension does not entitle you to a refund outside of the 30-day guarantee period.

5.2 License Revocation

Your license may be revoked, without refund, if you:

• Violate any provision of these Terms.
• Share, resell, or redistribute your license key.
• Initiate a chargeback or fraudulent payment dispute.
• Attempt to circumvent license validation or security measures.
• Engage in any activity reasonably determined to be abusive or harmful to Responsive Tester or its users.

5.3 Effect of Termination

Upon termination of your license, you must immediately cease all use of Responsive Tester's Pro features and uninstall the Extension from all devices. Sections 3, 4, 6, and 7 of these Terms shall survive termination.

6. Governing Law & Disputes

6.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

6.2 Dispute Resolution

Any dispute arising from or relating to these Terms or your use of Responsive Tester shall be resolved as follows:

• Informal Resolution: Email violetsmyster@gmail.com first to attempt to resolve any dispute informally.
• Jurisdiction: If informal resolution fails, any legal action or proceeding shall be brought exclusively in the courts of the United Kingdom, and you consent to the jurisdiction of such courts.

7. General Provisions

7.1 Changes to These Terms

These Terms may be updated from time to time. Material changes will be posted on this page with a new "Last Updated" date. Your continued use of Responsive Tester after any changes constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Extension.

7.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

7.3 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the developer regarding Responsive Tester and supersede any prior agreements or understandings.

7.4 No Waiver

Failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
